Acceptable Use Policy

Article 1 – Scope and applicability

1.1 This Acceptable Use Policy (hereafter referred to as the “AUP”) governs the permitted and prohibited use of the HOXX platform and related services (hereafter referred to as the “Platform”).

1.2 This AUP forms an integral part of the agreement concluded between you and HOXX BV, with registered offices at Karel Oomsstraat 37, 2018 Antwerp, Belgium (hereafter referred to as “HOXX”).

1.3 By accessing or using the Platform, you agree to comply with this AUP. Failure to do so may result in suspension or termination of access to the Platform in accordance with the applicable agreement.

Article 2 – General principles of use

2.1 The Platform may only be used in a lawful, responsible, and secure manner.

2.2 You shall ensure that your use of the Platform:

  • complies with all applicable laws and regulations;
  • does not infringe the rights of third parties;
  • does not compromise the security, integrity, or availability of the Platform;
  • does not harm HOXX, its customers, or third parties.

2.3 You remain solely responsible for all content, data, communications, and activities carried out under your account.

Article 3 – Prohibited content and unlawful activities

3.1 You may not use the Platform to store, process, transmit, or distribute content that is unlawful, fraudulent, or harmful.

3.2 The following activities are strictly prohibited:

a) Illegal activities

Use of the Platform in connection with criminal conduct or activities prohibited under applicable law.

b) Fraudulent or deceptive practices

Including, but not limited to:

  • phishing or impersonation schemes;
  • misleading or fraudulent financial activities;
  • unauthorized trading, investment, or financial services;
  • pyramid schemes or similar structures.

c) Infringement of intellectual property rights

Uploading, sharing, or distributing content that infringes copyrights, trademarks, trade secrets, or other proprietary rights.

d) Abusive or harmful content

Content that is defamatory, threatening, harassing, discriminatory, obscene, or otherwise objectionable.

e) Malicious software or code

Introducing viruses, malware, ransomware, trojans, or any other code intended to disrupt or damage systems.

Article 4 – Communication and messaging compliance

4.1 The Platform may not be used for unlawful or abusive communication practices.

4.2 You are prohibited from:

  • sending unsolicited bulk communications (“spam”);
  • using unlawfully obtained contact lists;
  • sending marketing communications without a valid legal basis where required by applicable legislation;
  • falsifying sender information or impersonating another individual or entity.

4.3 You are responsible for ensuring that all communications sent via the Platform comply with applicable data protection, e-privacy, and anti-spam legislation.

Article 5 – Security and system integrity

5.1 You may not attempt to compromise the confidentiality, integrity, or availability of the Platform.

5.2 The following conduct is strictly prohibited:

a) Unauthorized access

Accessing accounts, systems, or data without proper authorization.

b) Circumvention of security measures

Attempting to bypass authentication mechanisms or technical safeguards.

c) Unauthorized security testing

Conducting penetration testing, vulnerability scanning, or automated probing without prior written authorization from HOXX.

d) Interception or monitoring

Intercepting or monitoring data transmissions without lawful authority.

e) Social engineering

Attempting to manipulate or deceive HOXX personnel, users, or third parties to gain unauthorized access.

Article 6 – Infrastructure and resource usage

6.1 The Platform must not be used in a manner that disrupts performance or availability for other users.

6.2 Prohibited activities include:

  • generating excessive or abnormal traffic that degrades service performance;
  • making unreasonably high volumes of API or system calls without appropriate rate limiting;
  • uploading or processing disproportionate data volumes that materially impact system stability;
  • automated crawling or scraping that affects service availability;
  • using the Platform to attack or interfere with third-party systems.

6.3 HOXX reserves the right to monitor usage patterns and, where necessary, require customers to reduce usage, implement technical limitations, upgrade subscriptions, or migrate to alternative service configurations.

Article 7 – Enforcement measures

7.1 In case of actual or suspected violation of this AUP, HOXX may take proportionate measures, including:

  • temporary suspension of access;
  • restriction of specific functionalities;
  • removal of non-compliant content;
  • termination of the agreement in accordance with its terms;
  • notification to competent authorities where legally required.

7.2 HOXX may act without prior notice where immediate action is necessary to protect the security, integrity, or availability of the Platform.

7.3 Subscription fees are generally non-refundable in cases where suspension or termination results from a breach of this AUP.

Article 8 – Reporting violations

8.1 Suspected violations of this AUP may be reported to: abuse@hoxx.app

8.2 HOXX will assess reports in good faith and may request additional information where necessary.
